This article is about a guy who is up for consideration for a judicial panel that helps pick judges here.

JUNEAU -- Gov. Sean Parnell's appointee for the panel that nominates state judges testified Wednesday that he would like to see Alaskans prosecuted for having sex outside of marriage.

The candidate, Don Haase of Valdez, also admitted under questioning by members of the Senate Judiciary Committee that his official resume failed to disclose his leadership role in Eagle Forum Alaska, which advocates for social conservative issues. He most recently was president of the organization, but resigned when he learned of his nomination, he said.

Don't you see the big discrepancy in what you and he are saying? He's saying that it SHOULD be illegal, not that it IS illegal. It is a subjective opinion that should have no place whatsoever in his decisions as a judge. The danger here is that he is an "activist" judge who will in some way penalize someone based on that opinion - that just because he thinks it should be illegal that he will find a way to make it illegal. This is why activist judges are so bad for everyone.

However, as far as I can tell, he has not given any indication that he is an activist. The fact of the matter is that pre-marital sex is not illegal, period. He has no say in the matter.

Or are you saying that if a judge believes that the speed limit should be 100 mph (and obviously it's not) that that makes him unfit to be a judge?

There are extremists views on all sides of the political spectrum. Everybody has a right to be an idiot.

The governor should withdraw his nomination. Extremist judicial panel members make for extremist judicial nominations.

this is unfortunately the Sarah Palin - Tea party UBER right wing side of the republican party. There are still a significant majority of us "moderates" in the party.. just look at Senator Murkowski and her support for Obama...

Of course not! Gays should not be permitted to have sex. My guess is that he also believes that gays should be executed with extreme prejudice, but he knows better than to say it out loud.

As I've become older, I've seen the merit to banning certain personal opinions. Those that deny the inherent humanity or worth of other human beings should be banned, much as Germany did.

That said, he has not crossed that line. So right now, he's just a flaming idiot. And, unfortunately, that is perfectly legal. Besides, extermination of the world's idiots would be an impossibly vast program.

I think we can all agree that this will never happen. Still, I really am surprised that in the US in 2011, we actually have people advocating for such things. People are not going to stop having pre-marital or extra-marital sex, and there is simply no way to police such a law without seriously violating people's right to privacy.

Agreed. Everyone is entitled to their opinion, but when someone says something so immensely stupid and impractical, one does begin to question that person's judgement.

I do agree with this. The danger is in assuming that all Republicans are similarly nutty. Unfortunately for the rest of the GOP, the Sarah Palin/Tea Party types are incredibly loud at the moment.

Judges always have and always will issued legal "opinions". All rulings are based on the opinions of the judge (and juries) involved. They just have to follow the set of rules that have been established and then have their "opinions vetted and validated by a host of judges above them (if they are appealed).

I like the Republican that stated something to the effect of ""activist judges" are those that issue a ruling which you don't agree with". While I know many say that a judge can only rule within the confines established in the Constitution, that has been interpreted (by legal opinions I might add) such that we have the system we have today.

He is not being appointed to be a judge, the big issue is that he will likely nominate judges that fall into what his view of "acceptable" is. So he is more likely to nominate judges that hold a freakishly minority view that premarital sex is not OK (though they will be few and far between).

As to the idea that his opinions should be allowed, the problem is that it is not a justifiable opinion outside of a religious basis whereas the 100mph speed limit can be backed up with some justification. Additionally driving at high speeds is not a "natural right" whereas having sex is (within the societal limitations of age and consent). So his opinion is not really OK because it is not acceptable for one that is to represent the people of the state of Alaska.

Yes but many Republicans like to point out the nut job Democrats and paint all Democrats as the same. I have seen you argue that it is not valid to bring up what Republicans do when discussing the nuttiness of some Democrat's idea when it is used in the "I know that's crazy but have you seen what X Republican did?" form.

This would have been a big problem for me as my 1st wife enforced a post-marital sex ban. Could have been a virgin forever if I lived in this state

Well I'm not following her but I doubt she's still talking about the sex/marriage issue much. But I remember reading somewhere that her daughter was now abstinent again... right !

I'm *really* worried that this movement is becoming so mainstream. This is unprecedented. Until now, extremist positions, even when they've gone mainstream, have been geographically isolated. I actually submitted my resume to overseas placement companies because I'm really worried that the absolutely nonsensical policies that have been pushed through the UNITED STATES HOUSE OF REPRESENTATIVES are actually going to collapse the country and I don't want to be around for what comes after that.

You pass absurdly restrictive laws about personal behavior, then you cut all funding for any social safety net, then you ban abortion and restrict access to birth control so that those same people using the social safety net reproduce out of control. You defund all the schools. You defund any and all infrastructure other than roads. You make it next to impossible to obtain quality healthcare. And then you start inquisitions on an entire religion with government money!.

Oh, but the elected representatives sure want their Tricare. And their government salaries (which will continue to be paid if the Federal Government shuts down).

What the hell is going on?

I think it might be media hype. You have things like crime... it looks like it's rampant, out of control, and growing, but in reality it has been going down since 1990. Thank you media for accurate reporting. Personally I've seen my conservative friends lighten up a bit more on some issues. and the context was to do with adultery, a "pre-marital affair" would seem to be about cheating on someone you're in a relationship with.

There doesn't seem to be any condemnation of pre-marital sex, per-se... just outside an existing relationship, unless it's implicit.

Which then raises the problem of how do you define a relationship, when unmarried. Would dating then have legally binding consequences?

His position is reasonable and mainstream - for society 100 years ago, and still true for societies in certain other countries. He pines for a more orderly, god-fearing time, like it 'used to be'. It's a reactionary view, but not crazy, just his personal view of Utopia.

Who decides what is mainstream? The one who screams the loudest? What is there are 5x as many "quiet" people on the matter than there are people screaming?

Look, the guy is nuts. I wish he was in the house of representatives.... because then I could say "it takes some nuts to be truly representative". I don't like his opinions, but he certainly has every right to say those and think them, so long as he still does his job as required.

actually you are right about Sarah Palin's kids... considering one of her kids has already spit out a grandbaby for Sarah.. and probably not the last time she'll have grand children out of wedlock.

the abortion clinics here in alaska is quite the growing business... especially for the folks who live out in the bush. Cause there isn't much to do here but drink, fish, and @#*(#@. I'm still wondering how Ariel from Flying Wild Alaska hasn't been knocked up yet (unless its really true that most of Unalakleet is related to her)

But where is the good intention, exactly ? Premarital sex was frowned upon in the past, it was not illegal in most places, outside of the bible belt. Where is the good intention in wanting a law that would just put lots of people in front of a court ?

oh, I very much hope he is. In my opinion ANY politician who runs on a "Family Values" platform automatically and willingly invites VERY close scrutiny of him/herself and his/her family.
