How Do I Get Youtube To Remove A Video? (not Mine)

I need some advice on how to get in touch with someone at youtube to ask them to remove a video.

A not too flattering video of my kid sister has been posted on there, using her full name in the title.
It was posted by one of her "friends", who despite posing as a 17 year old on youtube is only 12.
We have contacted her mother about it, but she doesn't seem to think of the issue as a problem. She does not seem to understand that my sister (and several members of her close family) do not wish to have this video of her, with full name, visible to people around the planet.

I therefore thought that if they would not remove the video by our request, perhaps I could bring this case to some administrators on youtube, and see if they can remove it.

But in order to do that, where do I go, and what do I do? (Youtube isn't exactly straightforward when it comes to contacting them...)

Any help is much appreciated.

This might be of help to you. I found this when trying to 'flag' a video as inappropriate under "infringes my privacy."

I sympathize with you, and I´m sure you have legitimate reasons to wish the video put down, but if the mother does not want to do anything about it, your chances of getting youtube to remove the video are probably nil.

You may have to contact a Norweigian judicial authority to issue an injunction against youtube, but you will find the same problem, they will probably have to respect the mother´s wishes, unless you can prove the mother is mentally incompetent or the video has some kind of chld pornography component on it.

She does not have access to a computer in order to do it her self, but I imagine it should be no problem that I make a complaint on her behalf (and my sister's, as she can not make the complaint herself either.)

I shall contact youtube now, and hopefully the video will be removed soon.

I do not wish to supply a link to the particular video, as the whole purpose of having the video removed is to limit the number of people who see it.

Then I don´t see why is it so difficult to remove it. With the initial wording I thought it was your mother who did not want to. If Youtube refuses to remove the video where there appears a 12 year old girl whose mother does not want it there, they have to comply, I would assume. It´ll save you time and trouble if you go to a lawyer or the police. I´m sure in Norway they have a department that deals with this.

Or maybe in such open societies like Norway it´s a matter of free speech. If there is nothing unlawful in the video, you may not have a leg to stand on with youtube regarding its removal. I´m no expert with the law there, but I can´t see why if your mother has already demanded that it be removed, they are not doing it.

Apparently the mother of the girl who filmed and uploaded the video does not think it is a big deal, and is therefore not interested in listening to us. Hopefully youtube will deal with it. Should find out by the end of the week.

Isn't photography of someone without their permission a breakage of law.

Try writing to youtube on behalf of your family member.

The message I sent them regarding violation of privacy only allowed 200 characters, so I had to be very brief indeed. Barely enough to explain the situation really...

I assume your sister is a minor, in which case I'd have to imagine that Youtube would have to take it down if her legal guardian (a.k.a. your mother) requested it.

But I don't know the legalities behind it, especially in another country.

Have you tried contacting the authorities? Might be worth a shot to show up to her front door with an officer to request that the video be removed. Was the video taken on public property? Is your "kid" sister a minor?

YouTube guidelines allow the parent/guardian of a minor to file for removal. Just go to that link and start the process.

As YouTube videos are hosted on US-based servers, it will be far easier just to file a complaint directly with YouTube. For simplicity's sake, Norwegian law generally does not apply as long as no data is hosted on Norwegian-based servers.

In the US, when there is no reasonable expectation of privacy, you do not need permission to photograph someone. There are restrictions when publishing those images, but they generally don't apply to a site like YouTube (so long as the uploader isn't making money from it).

In my complaint to YouTube I'd open with these two sentences, focusing on the facts that:
A. The "friend" used your sister's (I'm guessing your sister is 12 or so as well?) full name in the title of the video;
B. The "friend" is only 12 years old but has misrepresented herself as a 17 year old to YouTube.

I'd expect the outcome to be one of three results of varying severity-
1. The "friend" is forced to change the title of the video, but it remains posted.
2. The video in question is removed from YouTube entirely.
3. The "friend" has her entire YouTube account shut down and all her videos removed because she lied about her age when she signed up.
Able to kill active threads stone dead with a single post!

Yep, I don't know how the law is in Norway, but here in Germany it is and it would be only a matter of few hours to force YouTube to delete such a video.
If not minutes, because YouTube don't want to spoil things with German privacy laws, due to the pressure by politicans in the past. AFAIK, Germany is the only country where people could have prohibit the display of their homes on Google Maps. Hundred thousand of houses in Germany are pixelated on that site.

To answer a few repeated questions;

Yes my kid sister is 12. Sadly I forgot to mention her age in the complaint I sent. (Seeing as I did not have many characters available, it's possible that I would not have room to include that detail in any case to be honest.) I do however feel that it might have strenghtened my/our case if I pointed out she was a minor, when making the complaint to youtube.

The content of the video is relatively innocent, but it features footage from a sleepover of 12 yo girls, and my sister was not pleased about appearing in this video in her pyjamas, and with her full name visible to the world. (Neither were we, the members of her close family, as we do not see why this private footage should be of interest to the public.)

The mother of the girl who videoed and posted the video on youtube argues that they don't need to remove the video as "none of the parents of the other girls in the video have complained." Seemingly missing the point that
1) none of the other girls are featured in the video with their full name visible.
2) if only one of the girls involved feels she is not comfortable with the video being online, that should be reason enough for the video to be removed.

It is now nearly 48 hours since the privacy complaint was sent to youtube, at which point youtube claim they will take action if the video has not already been edited or removed by the uploader. So fingers crossed that youtube will remove the video themselves within the day, as the girl who uploaded it still has not removed it herself, despite the warning beeing sent from youtube.

Again, unless YouTube has those images stored on a server in Germany, they cannot be forced to do anything.

Success!

Youtube have removed the video, and all is good. Both my sister and the rest of our family are pleased about youtube's decision, and now we can put this little ordeal behind us.

Same here. When we first contacted the mother regarding the video, we thought it would be very straight forward. Instead we ended up having to ask youtube to remove it for us... As long as she doesn't kick up a fuss over us having the video removed, we can just put this incident behind us now.
