Donald Trump Sues Bill Maher For 5M$

So I've just come across this piece of news... apparently Donald Trump is now suing Bill Maher for five million dollars for a joke Maher told on the Tonight show with Jay Leno.

What do you guys think? Does Trump actually have a shot at winning this? On what basis?

I must admit I'm a big fan of Bill Maher and have strongly dislike Trump - that being said I also think Maher's joke was reckless.

Reckless joke. Grounds for suit I think not. Show us the contract that he and Bill entered into that was legally force able. I don't see this getting past a hearing.

On the other hand, it's clearly not a legally enforcable thing.
It's like Romney's ten thousand dollar bet.
People make stupid bets all the time.
I'm no fan of The Donald but he's right to call him out.
However he's wrong to use up court resource on this dreck.

Honestly though, not wanting to start a flame war, but comparing Donald Trump to an Orangutang is really offensive to the Orangutangs.

Bill's joke was terrible, but it was obviously in humour and not meant as a real promise - even if it was - it isn't contractual, so I believe suing won't get Trump anywhere.

Depending on jurisdiction, oral contracts are absolutely enforceable. My knowledge of American law is rather rough, but in jurisdictions where verbal agreements are considered a contract, the only precondition is that there is witness and/or written document outlining the offer and acceptance. Since there is video proof of the offer, and online written proof of the acceptance, Donald Trump has a case.

I have to stress that this isn't the law everywhere, I believe it is a state-by-state issue. The only state where I know for sure that allows this form of contract is New York (there's some clear precedent), but Trump filed suit in California. If I have the time today I'll do a little more reading into the law in California to see if this can go anywhere. But those saying there's no chance of a successful suit because nothing was in writing are wrong.

Also, let's leave the orangutans out of this, they deserve better.

Yeah I don't like Bill Maher, but it made me smile a bit. I don't think it's legal grounds for anything, not even the $5m to charity thing (an obvious joke.) First world rich man problems if I ever seen any

Again, totally dependent on jurisdiction, but as far as I know you don't actually have to be in the same room for a contract to be formed.

1-Offer, 2-Acceptance, 3-Consideration

It *could* be construed as a contract, certainly. Whether a judge would do so, whether made in whimsy or otherwise, is quite another and, probably unlikely, interpretation. But context doesn't always matter on contractual law.

But I love Trump's brass here: he's laid down the gauntlet for charity, which means Maher looks like a douche if he doesn't at least do something and Trump wins a reprieve from Maher's unchecked mouth. To that latter point, Maher's said FAR worse and inflammatory--if not actionable--things. This may or may not be one of them but it'll be fun to watch unfold.

I haven't watched the clip yet, but I'm guessing the $5M promise harkens back to Trump's promise to Obama regarding his birth certificate.

In which case, it wouldn't be the same without the $5M. And also, I would think it would constitute a parody, legally speaking.

I do believe he probably has $5 million, he gave $1mil to the Obama campaign, and he does hold at least a small ownership in the Mets, so I doubt it'll ruin him.

Bill Maher's net worth is of 23 million dollars. So although the 5 million dollars won't ruin him, they do represent a substantial part of his fortune.

I'm afraid if be actually has to pay up, he will become a lot less outspoken and that's a shame because some outspoken common sense of the kind he is capable of is just too rare.

I find this very interesting. We don´t have oral contracts in Mexico. They don´t exist. I had to renegotiate a debt wtih a bank and they would call and offer all sorts of stuff but at the end of the day if it´s not signed in paper it does not hold. One time they got my customer to accept stuff and they said they would cancel part of the debt but they didn´t. When I complained to the relevant authorities they said "Nothing said over the phone is legally enforceable."

So I suppose that if a bet can be construed as a legal contract then it´s enforceable. However, I did watch that whole show, and it was clearly a joke. With that context in mind I suppose that no judge can find it is a contract.

I was lucky to watch that entire show. And yes, it all was related to Obama and Trump´s efforts to prove he was not born American. The whole time Maher participated was an entire joke. I´m not sure, as I said before, that with that context it can be construed as an oral contract.

It was humor of the absurd and wold be a joke in court.

But I can see Maher pushing it to the point of a video deposition where Trump has to answer a lot of questions that he would prefer to pass on - especially about his "hair". Actually having to state under oath if he wore a rug or not would be priceless. As would having to hand the rug over to Maher's attorney for inspection.

Even if it cost $5 million there is a good chance that Maher could get his money's worth with that video.

Under common law, a contract cannot be made in jest. It is whether an objective reasonable person would think whether this was an offer. This brings me back to my first case we learned in contracts. Specifically, somebody sued Pepsi because in an ad they said if they collected enough "points" they would win a harrier jet. Needless to say, the court threw it out.

I believe that Californian law relies on whether an reasonable person would construe the offer as being a serious one. There's a previous case on this (Leonard v. Pepsico, Inc), where customers could obtain points by buying Pepsi products (or you could buy 10 points for $1), and where Pepsico had advertised a Harrier jump jet for sale for 7,000,000 points. Plaintiff wrote a check for $700,000 and demanded that Pepsico provide him with a Harrier.

A key part of the sentence, which found in Pepsico's favour, read:
"2.The court found that even if the advertisement had been an offer, no reasonable person could have believed that the company seriously intended to convey a jet worth roughly $23 million for $700,000, i.e., that it was mere puffery."

Seriously, this thing on Leno is child's play compared to stuff Maher has said in the past. People need to realize his schtick is no different than Limbaugh or any of the others infotainment sector of the media (Maher and Ann Coulter are actually close friends by his own admission - probably to their mutual benefit). He says crazy stuff from time to time, makes good points from time to time, and does whatever necessary to maintain the persona that keeps the $$$ coming through.

Having actually read the transcript as submitted by Trump's lawyers, there's absolutely no way it can be construed as an offer to pay $5 million in exchange for Trump's birth certificate:

Yes, very revealing....

He says some vulgar and unnecessarily inflammatory things, supports Israel regardless of their actions, but for the most part, people I know in Europe, including most expat Americans, would agree with 80% of the actual concrete political positions he takes and critiques he makes of policy. That these positions, mostly traditional and centrist common sense, should cause many in the US brains to explode just shows how far the US has shifted to extreme right since Regan or Nixon.
When all's said and done, there'll be more said than done.

Maher takes potshots at left wing idiocy too, particularly with regard to blanket acceptance of all the changes US residents from other cultures (i.e. Islamic) want to impose on American way of life and histrionic conspiracy theories - he has thrown 9/11 "truthers" out of his audience on numerous occasions.

Case will never stand up because Trumps "birth certificate" "proving" his father is not an orangutan is clearly a fake. Note that orangutans are indigenous to INDONESIA where it seems Trump was actually born and we all know that that is where Trump went to a madrasa and became a closet fundamentalist Muslim. I'm contacting Orly Taitz to pursue this matter further.

As reckless as the joke may have been Donald Trump is a deeply delusional and paranoid man with a very thin skin, even worse than this, he has sued a contestant Shannon Minnon "Miss Pennsylvania" for saying that the contest was fixed... by the guy who sent some of his pales to Hawaii to search for "Obama's birth certificate" of whom he said "it does not look good" and said the election "was a sham". If anything Donald Trump has proved himself to be a big schoolyard bully.

Exactly, that clip clearly displays Trump's weakness in his inability to even remotely take a punch after launching so many. He exemplified the picture-perfect poster boy for the worse kind of Sour Grapes in that single moment... I can't recall anyone being 'set up' so perfectly to receive what they had coming ...and receive it in the worst moment and be so ill-prepared.

He could have at least faked taking a ribbing. Is it possible that Maher is setting him up now for an even bigger moment of embarrassment? ..if so, all indicators are he hasn't the slightest clue on what he's walking into and we know he certainly won't be able to handle it well.

Even since Politically Incorrect, I've never missed a show. I may be late catching up..but not one has escaped me.

I've disagreed with him on several occasions but it's usually due to his limited grasp on things such as the military or a business owner, but we all have areas we're a bit light.

It's not so much his making fun of them - that's what Rush, Beck and a child would do, he actually uses their own words & actions against common sense and logic. He calls them out on their own positions were very few journalist or interviewers ever would. He even invites them on the show (and without fail - if they show up) make complete fools of themselves as Ann Coulter & Christine O'Donnell did recently. He deserves enormous credit for constantly bring conservatives (who have guts like Issa & Jack Kingston) on his show and doesn't suck up to them. He even lets them skate on a few points of contention and they go unchallenged.

But it is the intellect that makes the divide, he's very well educated and makes himself extremly informed and well prepared comedian (like Carlin)..and that makes the difference. And it cost him people he was once friends with such as Dennis Miller, Victoria Jackson, Coulter, etc... very rare to find someone who's not some fake, phony & wanton kiss ass.
