Bashkiri To Sue Skyguide And DHL(!)

Read on Airways online magazine that Bashikiran Airlines have hired a German lawyer to sue Skyguide for negligence in a Swiss court (which sounds sensible) and DHL in a Californian court. DHL will be sued for negligence (their crew "ought" to have anticipated a problem when they heard that the Bashkiri plane enters Swiss airspace) for a compensation of up to US1million per pax. I find the lawsuit against DHL just ridiculous! So what, every time a pilot hears that another plane is at the same altitude, the pilot should .... park, pull-over or what???

Your outrage has a point, but in a business envioronment, sometimes hitting someone in their bank account has far more lasting (and positive) effects towards change than some faceless ruling by an investigating board.

DHL should not pay a penny, because, as I believe it was a mix up with Swiss ATC and the Ruski jet... Angry

I am not outraged, just puzzled by a legal system that allows for such lawsuits. Can someone tell me, what exactly could the DHL pilots have done differently, apart from not being in the airspace (i.e. staying on the ground) at all?

I am not outraged, just puzzled by a legal system that allows for such lawsuits. .... you can sue someone for anything though ridiculous suits may not make it to a judge....suing DHL may sound wrong but they probably feel they can squeeze a few bucks out of them....

DHL should file a counter-suit against Bashkiri and Skyguide. All the information released says these two were the ones who made the mistakes.

You can check out the investigation by browsing www.bfu-web.de and choose "bulletins" there. According to this inverstigation the main mistakes were made at Skyguide, not onboard of any aircraft.

Well, sueing DHL sounds like a bit of a joke. It is clear to me that, however unfortunate and sad this accident was, Bashkirskii Avialinie are now trying to cash on it.

where would DHL counter-sue Bashkiri? In the US, where Bashkiri has no assets (I assume) and does not fly to; or in Russia (if you can sue for that there)?

I doubt the DHL suit will ammount to anything. If Bashkiri was smart they would ask DHL to join them in a class action suit against Swiss ATC.

DHL did nothing wrong. They followed directions of TCAS. Why did the russian pilot not "anticipate"...?
