Picture From Airliners.net On CNN (AS261)

I was wondering if CNN contacted Vince J. LaMonica to use his picture on TV live. Picture from Airliners.net taken by Vince J. LaMonica is right now on CNN.

CNN gives Mr. LaMonica credit for his photo. Sounds like one tracked down the other.

They showed about a 2 second clip of his picture on one of the intros about 10-15 minutes ago. Trust me, his name was on the screen.

Copyright Infringement

I'm not sure on how exactly it would work in this case, but was this a copyright infringement? It states that it is copyright protected right under the picture on the web site. This is a private web site and the picture is private property. Who knows. There are some exceptions when it comes to news, but what and how much, only an attorney would be able to say.

It's probably one of those deals where it's easier to ask (and pay) for forgiveness than permission.

CNN could have used the pictures and then e-mailed him with an offer of $XXX to use them.

Hey I was wondering......if they gave any credit to this website for being such a great storehouse of airliner information???

After all, being in the news biz, it was probably a Producer at CNN who had known of this site and logged in, found the pic, and contacted Vince. At least that's one scenerio.

Without this site, would they have known to contact a Vince LaMonica for a picture of this particular jetliner?

Well, it's not hard to find. If you're doing research on a story that involves aviation and you search the web, I'm sure this website would come up.

Not to downplay the pic that's on here, but I have a shot of that plane, in full sunlight, no shadows. I didn't bother sending it to be posted because of the finicky and nitpicky criteria. If anyone would like me to e-mail it to them, or make up a print, either reply to this post, or contact me via private e-mail.

Yes, I think media circles are starting to check out Airliners.net with increasing frequency....I know the Boston Herald checks it out..   ..Congrats to the photographer regarding CNN..

Thanks for the concern re: using my photos with or without permission. I'll explain, for those that care, the timeline on the events that occured:

After I heard about the possible crash of an AS a/c, I contacted my best friend, AS employee, and fellow airliners.net photog, and got a bit more detail. I found that the a/c was an MD-83, delivered May 92; a quick look in JP confirmed that the only MD delivered to AS in May was 963. I searched through my collection and found 7 photos [4 were very similar], so I scanned in one, and submitted it. On CNN, I heard AS PIO Jack Evans confirm that 963 was the reg.

Johan posted the pic and e.mailed me to make sure I was sure that this was the exact photo of the downed a/c. I stated it was, and scanned the other two pics [close ups of the nose, one with my friend exiting the a/c]. But before I was able to get the other two submitted I received e.mail from the photo editor at Contra Costa Times [cctimes.com] and then cnn.com.

The note from CNN stated that they wanted permission to run my photo. I turned on CNN and saw my pic on TV! I called the person who mailed me [he left me his number] and granted them permission for the 3 photos for a sum of money that surprised me. They were given exclusive TV broadcast rights for these three photos, but said I could still sell the photos to other newspapers. cctimes ended up not using my pics [but still sent me a check].

I was also contacted via airliners.net by ABC, NBC, CBS, Discovery Channel Canada [who ended up using Michael Carter's pic] and about a dozen newspapers. I talked with the photo editors of and/or contacts with each of these agenices and, for TV stuff, had to turn them down. But I did find out that they do use airliners.net a lot for when an a/c goes down. In fact in one case, when a newspaper wanted access to another pic of an AS a/c that wasn't shot by me, they called me asking how to contact that photographer! I told them that Johan was the one who ran the site and then got a bunch of compliments about the site from them.

They stated it is the best resource for photos and that is 100% because of Johan's hard work. As a computer programmer myself [who's worked with SQL for over 9 years], I must say that the praise is well deserved, and it is nice to see the non-aviation crowd appreciate it as much as we do.

As you folks now see, the pics I took aren't the best, but due to the fact that they were the only pics for several hours, CNN and others wanted them. If any of you have pics of this a/c, I *highly* recommend uploading them, no matter what the quality of them is.

On a personal note, this was very difficult for me to do, as I am very close to AS, as part of their extended family. It's a very troubling to accept money for photographs that relate to such a tragedy.

BBC Used My Shot

Hi all

The BBC used my shot of an Indian Airlines A300 during the hijack............without my permission!!

I contacted them and they apologised.

So, come on guys, if you want to hit the headlines, get scanning your best shots for the site.
