WTO / Stage 3 Hush Kits

Recently there was speculation that EU might even ban hushkitted to stage3 aircraft from European skies.
The US retaliated by threatening to ban Concorde flights to the US, thus ending the Concorde's long carreer. It does have some other charter destinations, but everyone knows that that won't keep it flying.

Just wanted to see how you guys felt about this. I find the US solution to this very logical. IF the EU really wants to do this, than it's in the full right of the US to ban that noisy old bird from the US competely. Although I also heard that the US might withhold any new route requests from EU carriers.
In any case this promises to be an interesting battle.

Why would they ban a quieter airplane? Do they like noise?

Not Noise - Emissions

Europe's problem with Stage 3 hushkitted aircraft is not the noise levels, but the emission levels of the older generation engines.

Newer engines that meet Stage 3 without hushkitting are cleaner-burning, and so they emit fewer toxins to deplete the ol' ozone layer even further.

The Europeans have a point, if you think about it. If you ever able to, check out the emissions of a B707 or DC8 with JT3D engines on take-off -> that visible smog is what Stage 1 (hushkitted to Stage 2) engines put out; the Stage 2 ones (now hushkitted to Stage 3) got rid of the visible smoke, but still have the high emissions.
