Rulings On European Airlines Operating From The UK

Thu Jul 08, 2004 4:19 am

HI GUYS,

CAN ANYONE PLEASE TELL ME WHAT THE RULES ARE ON EUROPEAN AIRLINES OPERATING FROM THE UK.

eg: A TOUR OPERATOR WANTS TO CHARTER A SPANISH AIRLINE TO OPERATE FROM UK-NON EUROPEAN COUNTRIES.

I KNOW YOU CAN BASE A EUROPEAN REGISTERED AIRCRAFT HERE IN THE UK TO OPERATE TO EUROPE BUT CAN YOU BASE A EUROPEAN REG A/C IN THE UK TO OPERATE ON A CHARTER BASIS FOR A TOUR OPERATOR TO DEST OUTSIDE OF EUROPE.

NOT SURE WHAT THE RULINGS ARE AND WOULD APPRECIATE ANY INFO YOU MAY HAVE.

Pretty sure that an EU reg aircraft can operate from any EU airport to anywhere. Islandflug are limited to only operating within the EU, as Iceland, although a member of the European Economic Area, but not the EU. Air Atlanta, also Icelandic, set up their subsidiary Air Atlanta Europe (British registered) to be able to operate outside the EU. But then again, Air Atlanta aircraft used to operate outside the EU for Excel when still TF registered, so I think it's a bit more complicated than I first thought!!!

MANY THX FOR YOUR RESPONSE THERE,

I DID WONDER IF IT WAS ONE RULE FOR THIS AND ANOTHER FOR THAT BUT IF U DO THIS THAN U CAN DO THAT BUT IF U DO THIS THEN U CANT DO THAT.

SOUNDS LIKE THE TYPICAL AVIATION RULLINGS....NEVER SIMPLE.

I'd imagine actually getting the route approval may prove a bit more difficult than basing aircraft.

Air Malta have based a couple of aircraft at MAN, but they've been just doing flights in the EU, I think. As already said, Air Atlanta have had various 747s going to the US from MAN (as VS or other)

Air Plus Comet have also been operating for MYT on longhauls, and Euro Atlantic have been operating various services.

Other operations are to Tenerife and the Canaries, which although governed by Spain are not technically in the EU. Finnair also operate 757s from Manchester in the summer for Air Scandic. Those go to many different destinations.

A more relevant case would be Britannia basing aircraft on the British register in Scandinavian countries and Germany, to op flights within and outside the EU. Technically these are chartered from Britannia UK.

Route Approvals are more for scheduled operations.
Lead me not into temptation, I can find my own way there...

There are 2 different sets of issues here:

(1) Air Plus Comet/EuroAtlantic operating sub-charters on behalf of a UK airline like MyTravel to a non-EU destination.
(2) Air Plus Comet/EuroAtlantic operating a charter in their own right for a tour operator to a non-EU destination.

The regulations are obviously different for the above situations, however such applications are published on the CAA website - the page is updated weekly (Tuesday)

The relevant legislation is also linked to that page - read it at your leisure and knock yourself out!

There is also a table (in pdf format) of recent applications by UK airlines to use foreign-registered aircraft on a regular basis.

Sorry to disagree with you WhiteHatter but the canary Islands are very much a part of the EU, as they are not only governed by Spain but a part of Spain.
These are my principles but if you don't like them I have others
