Question About SXM App/landings

Read this question if you would like, but don't get mad at me or post stupid messages if you feel the need. This is an honest question I wsa thinking about after seeing these photos;

When the WN plane ran off the runway at MDW this winter, IIRC, the family is/was sueing WN....wether it be because of pilot error or whatever, the main fact is that the family is sueing WN.

Let's say you are at SXM, and a KLM 747 is on approach, clips the fences and happens to hurt/kill someone....can KLM or whoever be responsible? Or would they claim that a person shouldn't be on that fence in the first place? Would it be the end of Maho Beach?

Again, don't flame me for the topic, it's just a question and is not inteded to be rude or disrespectful

Probably wont work because only in the US can someone actually win a case like that and sue whatever and whenever he wants...

But to try to answer your question: They have a warning sign at that beach warning from the aircraft. So as long as they dont actually clip the fence or anything similar, every person standing there or being in the area is responsible for themselves.

I don't know if there is another thread on that 747 picture (I couldn't find one), but it looks like it's about to touch down on the blast pad behind the actual runway. Kind of a big no no.
