Man Ordered To Pay Hawaiian Airlines For Diversion

A passenger travelling on a Hawaiian Airlines flight last summer from HNL to PPG has been ordered to compensate HA $19,000.00+, after he was convicted of assaulting a flight attendant during the flight. After the assault, the flight was diverted back to HNL where the passenger was arrested. HA claimed that the diversion cost the company $19,000, and was awarded this amount by a federal court.

That's awesome! Good luck collecting it though, eh. Folks in PPG don't have a pot to piss in, for the most part. Go on vacation once every ten years and don't know how to act on an airplane. They're lucky you still fly to PPG, as far as I can tell. Anyway, we're just waiting to head over to HNL and get on HA8, the red-eye to Vegas, tonight! Love your posts, love HA!!!

I wonder if that 19000 will be divided amongst the passengers for compensation and delays, or dissapear into the companies shareholders as dividends for a good days work ?
So far in 2008 45 flights and Gold already. JFK, IAD, LGA, SIN, HKG, NRT, AKL, PPT, LAX still to book ! Home Airport LCY

Probably goes on the extra fuel, airports fees and the costs of transferring passengers who missed their connection due to this passengers actions.

I'm sure the $19,000 award was for the cost of:

Fuel, landing & handling fees, payroll and maintenance.

Had HA asked for "compensatory" damages for the delay to compensate passengers, I don't think it would have been approved by the court without a lengthly legal analysis and additional expense.

However, verifiable operation cost can be easily proven.

And in a little over 65 years Hawaiian will receive the last of its money. Aren't time payments on fines and compensation great  Yeah sure

Doesn't being convicted of assault result in deportation from the US? The article states that he is Samoan.

It appears he is American Samoan. So there may well be different rules and regulations given that countries relationship as American Samoa is a US Territory.

Except as WorkFlyer said, it isn't so awesome when the guy only has to pay $25 a month because he "can't afford" any more. What's the betting this clown even defaults on this amount too.

If I'm not mistaken, Samoans are US citizens, at least from American Samoa.

Brilliant.

Didn't a judge a few years back order the same thing to a man on an NW flight from NRT-MSP? He got drunk and started becoming dangerous. They had to dump fuel and land at ANC. The man had to write appology letters to all passengers, write an essay about the environmental impact of fuel dumping and pay a big wad of cash to the airline.

I was chatting up some of the crew on the HA flights I just took about this, and two of the more memorable comments fom the crew were: "What's he gonna pay with? Breadfruit?", and, "I only know one Samoan who's got money: our Mayor!" (Mufi Hannemann, the Mayor of Honolulu.) And P.S. I was told that the FA that got punched is one of the nicest, kindest and most popular FA's in the entire HA system; and a regular on the PPG route. So everyone on board was doubly mad at the idiot who punched him. Let this be a lesson to all the idiots out there!

A precident has however been set. US$25 a month or not, the deal is done and it will make it easier for airlines to sue for and collect compensation for these diversions. . . . it's about time.

I just love stuff like this. This case aside, every time some moron creates an inconvenience for the people around them they should be held liable. Next time it wont be a poor samoan, but a wealthy businessman who got drunk and biligerent and he will be forced to pay $100,000. As long as the precedents are being set, I'm happy.

No doubt. I would assume that if HA has a "no-fly list", this dolt would be on it. Perhaps that could serve as a preview of what's to come should the American Samoan governor get his wish: just try getting back to HNL or the US mainland without HA.

Sad truth is, with the litigious nature of most Americans these days, it's usually the airline, the government, or someone else's fault. It's about time that people - regardless of color, personal wealth, or status - be held accountable for their behavior.

Acutally, American Samoans are U.S. nationals. But they still are subject to U.S. laws.

That's quite funny. On the serious side, many families in American Samoa tend to be land rich, but money poor.

That's awesome. Its great that he had to write apology letters and an essay. Wish they would do this kind of stuff more.
