A.net Pics On Ebay

I have recently noticed that when a "certain" person is trying to sell something on ebay he/she might give a link to a a.net photo of the a/c that this item was from. Is this possibly illegal? And if not, should the seller AT LEAST contact the photographer?

I fully read that topic before but this is a different case as previously mentioned in the main post. This person is using a picture to promote sales.
