A First - Got Pics Stolen!

I got an email over the WE saying that my pics were up on website and asked if I had given permisission. Since I usually grant permission to such requests, I thought nothing of it at first, but after further exmaination of the site and my previuos correspondance, they had never emailed me about it !
Now the site is purely non-profit and I am credited for the pics. There's even a link to the large version on a.net (hits! hits! hits!).
It's a spotter information site so obviously no money is made, and I would have given them the right to use it anyway, but still, they should have asked first. What action would you recommend ?

They should have asked for your permission before using your pictures.
I personally would mail them and their webmaster and explain to them
they have to ask for your permission before they use your pictures or
you would take legal action and have your pictures removed from their
website and demand financial compensation.

Personally, I think that's something of an over-reaction. The site is obviously non-profit making, so demanding compensation isn't going to get you very far. Asking to have your shots removed is somewhat self-defeating as well. I have had a number of requests to use my shots on non-profit making sites, and, as long as I get credit for the shot, I'm always happy to allow it. I have found one web site that has used one of my a.net shots without my permission, but they have at least given me the credit for it.

I have to make two things absolutely clear here -
1 - In no way am I condoning the illegal theft of copyrighted images from this or other websites.
2 - I don't take photos to make a profit. For this reason, I'm somewhat flattered that someone wanted to "steal" one of my shots. However, if Flight International did want to use one of my shots on their front cover, then I might consider letting them force some money my way!  Big grin

I totally agree with Bromma1968
If they don't bother to send you a mail and ask, then they shouldn't have the pleasure of using your picture to enhance their site. Don't feel ashamed to let private sites know that the rules apply to them also.

Not IMO, it shows integrity, and that you want to be in control of where your pictures end up.
Some people might also think about their reputation and don't want their high quality pictures on a low quality website.

William - I assume you are talking about the use on Plane Mad (my website).

I am also a photographer on here and take photo use VERY seriously.

Basically somebody else wrote a guide on an airport for use on my website and said he had permission to use your photos.
The e-mail I sent to you was to make sure you had given permission and that he wasn't just saying you had given it (as it sounds he has!)

The page you have viewed is online as it must be for you to view it, but it IS NOT accesible to anyone unless you know the exact URL, there are no links within my website to that page!
The page was created to show you how it would look with your photos on there, to show you that credit is given to yourself and make sure that you are OK with them appearing that way.
The page is not currently accessible by anybody else and only you would have viewed the page so far, take a look at the rest of the site, there is no link to the page with your pictures on.
By doing this I beleive I was going the right way about asking, giving you (but nobody else) a view of exactly how the page would look if you allowed their use.

I am sorry if there has been confusion or if you feel I have gone the wrong way about this.
The photos can be removed from the page before it is made public, please let me know either on here or by e-mail and they can be removed straight the way.

As I said above (and I didn't kmow you were an a.net member lol).
The site is obviously non-profit and very well done, so i have no problems of having my pics put thre. Now I send out so many emails per week, maybe my answer somehow slipped through the "sent" folder or got erased somehow. Now I obviously keep good track of correspondence relating to photo sales...less when it comes to authorizing non-profit sites to use my pics for free. Anyway, from now on I'll keep all photo-related correspondance, paid or not. Dan330, keep up the good work and feel free to use any of my BHX,LGW,LPL or any future UK pics for your site mate !
