My Photo Being Illegally Sold On Ebay

Sun Sep 05, 2004 11:07 am

I was looking through ebay tonight at the B-1 items when I came across my B-1 photo being auctioned off without my permission. You might want to check out his other items to see if he is selling anybody elses photos also. The nerve of some people to think that they can lie and get away with selling other peoples photos.

It seems like this [censored] sold a lot of prints already. I suggest that someone who's photos are there contacts eBay, and maybe Police to give him a lesson.

Mdwalkman - Cactuswings, looks like they are Jeremy Irish's shots (and being sold by him), so nothing to be worried about there.

Greg - Just have him remove it at least. Seems like the other photos he's selling are not from here.

Complain to E-bay.

I think they are trying very hard to keep scams to a minimum.

You won't be able to give him negative feedback unless you purchase something from him. Even then - you'll only be able to do it once.

Doing a completed item search; he has attempted to sell the picture three times within the last 90 days using that title. All three times have had no buyers, and on the last attempt he even lowered the price one dollar.  Yeah sure

I'm pretty sure that this photo is from the US Air Force's web site:

http://cgi.ebay.com/ws/eBayISAPI.dll?ViewItem&category=14050&item=2244042646&tc=photo

...and I know that this one came from Boeing's site:

http://cgi.ebay.com/ws/eBayISAPI.dll?ViewItem&category=14050&item=2262561749&tc=photo

Where in the world does this guy get off thinking that he can just sell any photograph that he gets his hands on?

I'm curious how this guy gets away with this. I'm surprised his photo printer hasn't caught on to what he's doing. Most photo labs are very familiar with copyrights, an what happens when you illegally print copyrighted material.

Everything he is selling I believe is 8X10. Most likely he prints them out himself. Has anyone contacted e-bay?

We I have contacted eBay before they have always been completely not interested. I have always been told to contact the seller and sort out my problem. I always get the impression that as long as someone is paying eBay the fees it is due it doesn't care about theft and people getting ripped off.

On a different copyright note has anyone checked out http://www.dynamicartsgallery.com/ - I was contacted by a photographer who tells me this guy is creating his photo's from many others and he has used 2 of mine to make 2 of his limitied edition prints of which I am also told he has sold quite a few.

Has any one thought of contacting Boeing or the US Air force about his blatant Breach of their copyright as the US Airforce/DOD have a very dim view of people ripping them off and Boeing have a similar attitude to such people!

You may find the following eBay page helpful. Refer to it in any contact you have with eBay.

http://pages.ebay.co.uk/help/policies/unauthorized-copies.html

eBay should remove any auction (temporarily at least, if the claim is unsubstantiated it may be resumed) where there is a suspected copyright violation or leave themselves open to claims from the legitimate copyright holder. Try to give eBay as much help as possible (the person who reads your contact will may know little about what it is you are complaining about) - I think a link to the airliners.net location of any photographs would help as it clearly displays the copyright statement and owner.

Best of luck!

Regards,

Jim

many of the 1100 (!!!) pictures he is selling are taken from the DFRC DrydenFlyResearchCenter website from NASA! on this very informativ site is a great gallery with many high quality pictures of the X planes. a good source for print material...

for example;
he is selling prints from the X-29, the B-70, the X-3 and many many more planes.

i think he don't have any rights from the real photographers!
hope he will be arrested!

One thing that all of you have not read is the Privacy Disclaimer on the U.S. Air Force Site where these photos have come from states:

Item # 2:

2. Information presented on Air Force Link is considered public information and may be distributed or copied. Use of appropriate byline/photo/image credits is requested.

http://www.af.mil/main/disclaimer.asp

The Photos once obtained by the U.S. Air Force becomes the property of the U.S. Air Force and are used as they see fit. It is the same situation as a camera man the works on a major motion picture such as Star Wars. That camera man has no rights to the footage he has filmed because he works for the studio that makes the film. The studio owns the film and has rights to do with it as they see fit.

Please be informed before you make judgement or threats against someone.

Just a question : Did all the photographers that have their pictures on sale on eBay have first given their pictures to U.S. Air Force ?

And I also don't understand why I also received this email from Mr. Seebaran mentioning this link (http://www.af.mil/main/disclaimer.asp), since I haven't found any of my pictures on eBay, nor on USAF website.  Confused

Zukuhov, I also received a msg from Mr. Seebaran (apparently Jetsetter07).

Apparently he perceives my comment about E-bay in reply #9 as some sort of threat.

I made a comment about E-bay, some advice to the thread starter, but not a threat to the person running the auction (Seebaran).

Yep, Jetsetter07 shot an email off to me too for my comment in reply 13. I hope he never contacts me again...as it's a waste of bandwidth. Jetsetter, if you care to elaborate, do it on the forum, don't contact me over email...so doesn't the person taking the photos of USAF aircraft first have to either be working for the USAF or give their photos to the USAF in order for the USAF to have rights? If a person makes a photograph on their time, while in a public access area, it is THEIR photo. Could I possibly be wrong? <-Any body can answer that.
