Military Badpeople?

I had this photo rejected yesterday for 'Badpeople'

I know that there has been a lot of discussion around the 'Badpeople' issue on a number of threads the last year however I am not sure that they have entirely covered this scenario.

This photo was taken back in 1987 on one of the public days at the International Air Tattoo at RAF Fairford. It was raining and the two soldiers were sheltering under the nose of the KC-135E and obviously were not going to move so I took the photo. In the course of the two days they would most certainly appear in tens of thousands of photos taken by the public at this very popular event, indeed I have often seen members of the public ask such military personnel to pose in the photo of the plane.

My argument here is that, a bit like military air demonstration team pilots and crew, these military personnel know beforehand that they will be photographed at such an event and therefore their 'permission' to be photographed has already been given, albeit on an implicit basis.

This was also 18 years ago and I would very much doubt that they are still in the military, also how would I have known to ask their permission when A.Net was not to exist for another 10 years or so?  boggled 

The other argument for rejection of this photo could be that their presence detracts from the aircraft itself. Personally I don't think they do, in fact I think they add to it by emphasising the military aspect of the event, however I do see that others might have a different view and would respect that.

Any opinions on this one? I am not having a go at the Screener who I suspect has followed the guidelines in place so no problem with him/her, I just think that the event it was taken at makes invoking the 'Badpeople' rule a touch harsh.

Neither the fact that photo was taken few years ago or the fact that these guys were in military waves their right to privacy in my opinion.
