Someone Wants To Use My Photo, Your Advice?

Fri Apr 01, 2005 9:22 am

Hi, I've never gotten one of these requests before so I'm wondering what you guys would do. Someone wants to use my photo in a commercial presentation, and asked me what my conditions are.

I just barely got my first photos onto a.net a while ago, just three of them, so I'm surprised, and not quite sure what exactly I should do on this. I don't have a problem at all with someone using the photo...as long as I'm given credit for the picture, but what else should I say here?

I'm sure you guys have gotten something like this before so can you give any tips? Thanks.

The photo in question is this one:

In respect to the person who is requesting use of my image I'm not pasting the email sent. Just asking advice on this one since it's the first time anyone's wanted to use one of my photos for anything.

Thanks for any advice!

Well, last Summer a guy who runs an Italian MD80 website wanted to use a pic I took in IGM of a prototype MD . I was so flattered I said yes....

I wouldn't charge for my pics,it's just a hobby...

I would charge for the image even if it is a hobby - you spend time and effort getting the photo. What you would charge depends on the proposed use of the photo. If it is commercial such as a brochure then charge more. I recently charged $425 USD for a photo that was going onto the front page of a brochure for a company that repairs flight control surfaces.

"I was flattered" isn't gonna pay my bills. I'm an unemployed college student who's been trying my arse off to find a job in an empty market. Every time I see someone just give away their photo it really pisses me off.

It totally depends on what it is being used for.
I give use of photographs away for free on an almost daily basis for use on non-commercial web sites (my oldies are very popular in some quarters).
If it is being used commercially, try asking what the standard rate for the use is and see if that is acceptable to you. If not, ask more and see if they still want it.
I have recently been told about an illegal use of one of my photos and I added 50% over what I expected for the photograph, told them that was what I had done and why.
They are paying !

I read this in a thread once, I wrote it in a thread yesterday and so I'll write it again,

Canon, Nikon, whoever, didn't give you you your camera for free, so why should you give your photos away for free.

This is a hobby to me too, but if a company wants to use my photo then as I always say, Show me the money!!
Companies have budgets and they are usually large ones but they will always try to get it cheap, or for free. Don't let them rip you off. Your photo is just as good as a professional otherwise they wouldn't be asking you for it, so why should you give it away for free. A professional is going to charge them a lot of money and they are trying to get it off you cheap. They are saving a lot by going to you. I'm not here to rip anyone off, but I'm not here to give out my photos for free. Yes there are instances where I do in certain circumstances.

Just my thoughts

That is interesting, I had an identical request just a couple of days ago for this photo:

Do you know how many copies they will print ?
What size will they use it in ?
Will it be used on the cover ? Centerfold ? small image in a page ?

There are loads of factors to consider when giving a price, because you SHOULD give them a price.

Like many said before me in this thread... Even if this is a hobby for you,
they ARE a commercial company and they DO have budgets for this.

Why sell yourself short ?
* Wasn't your camera expensive ?
* Didn't you have to pay for the lenses ?
* Do you get your memorycards for free ?
* Haven't you spent A LOT of time gaining experience in photography?
* Haven't you spent A LOT of time learning photo processing in Photoshop (or similar) ?

Ghostbase:
If it's a commercial request I really think you should charge for the usage of your photo too.

For non profit organisations and private users I do exceptions, but for
commercial use, NEVER.

Thanks Tommy. Yes, I was going to do that, just not had time to think what the 'going rate' should be. I need to take a look at that website which has been recommended when this question of what-to-charge has been raised before.

I have been approached a couple of times now by authors wanting photos for free for books that are commercial ventures and the answer is a clear "No!". One of these came back and said that he would send me a copy of the book but again if you don't know what the book is going to be...
