Balkan Holiday Using Our Photos

Mon Aug 01, 2005 5:03 am

http://www.bhairlines.com

If you click our aircraft, 6 photos come up, with the copyright bar still on the bottom. Not sure if they asked permission, they might have, but I just wanted to give heads up.

I noticed that a few months ago. Though, as they are a quite a large Airline, I though they would have had permission to use them. Also, I wasn't so aware about the misuse of Photos then.

All will be revealed.

Check out the funky seat covers in the cockpit shot. How 70's are they?

Re: Balkan.

Those photo's they are using, I reckon they did get permission.

They asked me, telling me that 'other photographers' in a.net had offered their images for free.
So they wanted free use.
I declined.

Hi , have waited before i posted this .... they have used at least 2 of my images without my permission !

I have mailed them in the mean time ... which i guessed would be a waste of time as the email on the site is dead ...

so i emailed the webmaster and the offices in London ... and am still waiting for a response ( mailed them again today with warning )

if i get no joy by this time tomorrow ill phone them direct in London and Sofia ... i dont care if they come up with the " were a seperate office" *BS* they work for the airline therefore have contacts to pass the problem onto

Im not letting this one go , there are far to many of these people who think they can get owt for nowt !

ill keep you posted on any updates

regards Tony

I,along with other on this website, believe the OPTIONAL watermark in a good location will protect the photographer inclined to use it.

Watermarks...an old idea but the time has come.

Tony,

Maybe as payment they may offer you a flight on one of their nice and safe TU154's and a week at a 3* hotel in Bulgaria Big grin

Perhaps you should definatly push for the cash  rotfl

Joking aside good luck all and let us know how you get on

Cheers

Hi All,

I just spoke with Staurt Prince, they did get his permission, but it took him ages to get anything for it, in the end they gave him a free flight on the Tu154 to Bulgaria, return for free.

Tony, i think you should push for the flight.. haha.

Cheers,

Lew

***UPDATE***

I am still waiting for a reply from BHAir regarding this situation ... i have had responses from the London offices but as for the HO ... Nothing !!!

So i am begining to think this Airline has no intention of replying or anything by the looks of it ... so ... i have taken advice with a solicitor and am waiting to see what they come up with ...

While this is happening has anyone got any contacts from previous theft or experience from BHAir ?

The email on the home page is none existent .. Surprise surprise .... Makes you wonder how they survive doesn't it ?

Regards Tony

First of all: I'm all on the photographers' side here, so please don't get me wrong.

But I wonder if you can actually force an airline to stop using photos of their own airliners on their own website. Or if you can, could not the airline, on the other hand, force you to stop offering them commercially on a site like this without their permission?

Don't get me wrong, I don't want to imply anything here, and I would definitely appreciate if the photographers would be properly compensated for their good work. I just wonder about the legal background. Does the photographer really own the copyright of his photo, even if it shows objects that are again themselves copyrighted (like airline liveries etc.)?

To ZakHH.. The copyright belongs to the photographer.
It's been discussed many times and the position is crystal clear.

To Tony: I recall it was a commercial director that was hawking for
easy photographs a couple of years ago. Free flights was an 'option' but only on his terms. I was not in a position to chose my 'out' and 'return' dates on their nice 154's, so nothing happened.

If I still had his old e-mail addy, I'd pass it on to you, but I've had a PC
crash since, so i've lost it.  gnasher

I would think allowing them to use your photo and getting a free flight is a good deal.

It would if they didn't use a TU154!!

3* hotel? Doubt it. If they have a 0.5* a/c then the hotel will probably be alike Big grin
