Possible Copyright Violation - Need Your Help

Wed Aug 03, 2005 10:48 am

First of all let me say that I am extremely glad that there were no fatalities in today's accident at YYZ. It is amazing that all those people got out alive, and without any serious injuries (or so they say). In the wake of today's accident at YYZ, I don't want to sound insensitive at all but I am a bit curious about something.

I was at the flight school today when I got a phone call from my father telling me to turn on the news if I could, that an AF jet ran off the runway at YYZ and was on fire. I turned on the TV there at the school and it was already on CNN news and they were showing the image from the traffic camera across the 401 from the airport of the burning airplane. They also proceeded to show a picture of an AF A340 from the spot near the // taxiways at CDG. I almost instantly recognized it as being familiar to me, and I thought it may have been either mine or Chris Liao's photo here on a.net. I only saw it for a second or two before they removed the picture, so I didn't get a real good look at it and the photo wasn't my main concern at the time. However, if anyone else saw it on CNN today and if you thought it looked like one of these....please let me or Chris know. I thought it looked more like the K64 slide but I am not sure.

Again I don't want to sound insensitive to the matter, but after all if CNN did post one of these photos, it is still a copyright violation, regardless of the accident that occurred.

Thanks

If they posted ANY of those pics without copyright's owner permission its indeed a violation of law. But in the previous posts I don't see any "I'm sure, it was my picture...".

I know that the title of this thread is "Possible..." but I think its better to be sure before making any accusation against any serious News Channel like CNN.

TACAA320:

thank you for your help in the matter. your post has done wonders for me in my search to determine whether or not one of these pictures was used. so what if i'm not 100% sure, that's what i'm trying to figure out....thats why i requested the help of others, because unless someone else saw it i won't know for sure. heaven forbid i ever get another feeling that one of my pics (or one of my friend's pics) may have been used without my permission  Yeah sure

They definitely showed an a-net picture on CNN Latin America, but it was for a few seconds and the image was way too small to be able to see the copyright bar, but it was for sure from a.net. Don't know if it was your pic, but it's obviously some a.net photog that might want to look into the matter

I am still amazed how no one perished in an accident like this one. Well done to the crew and to the emergency response at the airport!

Start by recording CNN. They could so easily blow the tape away or cut it out. If you have it on tape, there's no chance of that.

If they did use them without permission, you must follow it up, without a doubt. I'm not sure whether a photographer would charge in a situation like this (there is inevitably a morality question regarding the use of an image featuring an accident aircraft) however it demonstrates a pretty poor ethic on the media's part if they are stealing images - copy deadlines are no excuse.

Thanks to resources like airliners.net, there is - it's quite safe to say - an unprecedented, rich archive of aircraft photographs that everyone has access to. Just ten years ago there is no way the media would have been able to retrieve a comprehensive pictorial record of an aircraft so quickly.

This wouldn't be the first time CNN pulls this stunt. When the Kish F50 crashed they used Olaf Jurgensmeier's photo of it. I got an e-mail once saying my pic of an SAA 744 was used in their "business traveller" program. I had no way of catching that show myself. All e-mails sent to CNN were stonewalled.
what seems to be the officer, problem?

CNN a serious Channel !!! I don't think so. I had the possebility to compare live journalism yesterday on several news channels. CNN is lousy quality. they just blast anything out and nothing is verified. (OK, its still better then the propaganda from Fox News...)

It would be tough to get a screenshot of the televised newscast.

I would actually jsut email them and say that you believe they used your photo without permission. See what they say. Couldn't hurt and you can more easily sniff out the bullshit.

Everybody is entitle to their own opinion.

And yes, I ever think that CNN is a serious and reliable news channel.

Maybe not the most reliable, but for sure among the top. CNN is usually the first news channel I check whenever major events happen. For deeper analysis, I then usually go to BBC

Not a screenshot Phil, but a tape. The way they re-broadcast stories, set your VCR to tape CNN for 8 hours. Almost a sure bet it would come up again.

Indeed a quite serious and responsible one is BBC. Do doubt about it.

I just want to point out that CNN is serious business. They don't give 100% accurate aviation news? Maybe yes. But most of the time is a reliable one.

RE: Possible Copyright Violation - Need Your Help

Last February three TV stations in the Noo Yawk area used a pre-crash image from my website of the CL-600 that ran off the end of the runway at Teterboro.

The first station called me for permission and we worked out a price. I spread the word to a couple of buddies of mine in the NY area and one or two of them soon tipped me off that WABC-TV was using my image on their broadcasts.

Fortunately their website had video of the broadcasts with my image used behind their announcer and I got a few screen shots of it. They didn't even remove my name that was printed on the image.

Later that night I went to WCBS-TV's website out of curiousity and I found more video with my shot used behind their announcer, again with my name printed on the photo. I sent both stations invoices with prints of the screen shots, via FedEx so I would have confirmation of delivery time and who signed for the envelopes. I also sent an 8x10 print to the U. S. Copyright Office to register the image with them, which allows added benefits if they didn't pay up and I took them to court.

WCBS-TV paid in May and Disney/WABC-TV News paid last month (5 damn months!) It was well worth pursuing the matter.
