Is This The Same Photo?

Hi all,

I was searching for some flightsimulation software and came across this site.

They are promoting some new products on their DC-10 line.
On one of their products is a picture visible of a Olympic A300 tail.

First thing that came up in my mind was... hey this is one of my photos.

What do you guys think? Is it the same photo,and if it is how to handle with this company?

looks like it to me. only thing you can real go on is the shaddow of the tail.

William,

I think it's likely to be your photo. The dash of light on the lower surface of the stab is especially suspect.

But I guess it will be impossible to prove in a case like this.
If they simply deny it, which they likely will, it will be a lost case I'm afraid.
I'd say you can give it a try of course, but be prepared to rest your case.

I think it really is William.
The dirt in the blue bottom right ring is identical I would say.
Difficult to proof though but who knows what will happen if you send them an email.

After two emails in the past two days the guy or company is not respond at all  Angry
It is a real shame that this company make money with other people photos.

A photographer that read the forums over here send me this edit photo to proof it is for 100% my photo that is in use!
He crop my original photo and overlayed it on the box with transparency

So if your photo is here and they don't ask permission email this company.

My brother told me today of a court cage here in the Netherlands.

A news paper did use without permission a photo of someone, and was sued by him.

The newspaper lost their case, had to pay 2300? to the photographer + the costs of the courtroom.

So, my guess is that you can go pretty far with this. They do make money with a little help of something that doesn't belong to them.

The president of flightsoft Mr. Zoffreo contacted me last night.
He will check into this matter at once on Monday morning.

So maybe this story will have a happy end  Wink

He also told me that most of the photos were given royalty free and in some instances deals in exchange for free products  Yeah sure

Well, I cannot speak for other photographers here but in my case the photo was not given royalty free.

So we will see what happen Monday!

Remember, the company might be telling the truth. It's entirely possible that somebody else ripped off the photos, removed the copyright bars and then gave them to the company in exchange for free product or something. The company MIGHT have been innocently duped. Just look at the "idiots" who post A.net photos on eBay and try to sell them. Could be the same scenario here.

It will be interesting to see the outcome of this situation. But from the sounds so far, the company is responsive, and that's a good sign..... so far.

For those who are interested I have some news in this 'Flightsoft' matter.

Mr. Zoffreo contacted me again yesterday and he appologise for all the problems around the Olympic A300 photo.


He ask me polite for permission and as service in return he offerd me the complete product line of 'Flightsoft' for FREE.
That is about eleven packages for Microsoft Flightsimulator 2004.

I accepted his offer.

Case closed Big grin
