You’re correct that this is indeed the legal position under EU law but there is also the position under UK law to consider. I'd probably say the closest to this is Flybe in the UK. They operate the largest fleet of Q400's (approx 60) in the world alongside a mix of E175 and E195 (22). Some would say that they're not especially cheap but in the regional game I think you're limited with how far you can go.

Flybe's Economy Plus offers an upgraded experience on the ground but no additional benefits in the air, except complimentary drink/catering/hold luggage and seat selection.

I all for expansion but they will need to address their ageing fleet in the near future which will be at some considerable expense and i'm not sure they have the investment necessary.
