Surely TK's Conditions of Carriage addresses the luggage issue? So at the time of taking the passenger's money, the passenger agreed to those. If you then pitch up with too much baggage, not the airline's fault.

If your fear is that they will go under after you purchased your tickets, I don't think you need to worry. They may be in trouble but they will be around.
