This is a bit concerning, since the 9th Circuit is historically one of the most liberal circuits in the U.S. Court of Appeals, and it is rather unfortunate that Arizona has to be part of it. Governor Doug Ducey even wants to leave the 9th Circuit and either join the neighboring 10th Circuit, or create a new 12th Circuit with other non-coastal 9th Circuit states; some broader proposals for the 12th Circuit would even take every state from the 9th Circuit except for California and Hawaii.
The past eight years of appointments by President Barack Obama could have set the court up for another generation of dual-barreled progressivism — and commensurate conservative loathing. But that’s not how it seems to be turning out. Instead, the 9th Circuit seems to be growing more centrist. This conceptual distinction can extend to judicial philosophy. Many Carter judges see their judicial responsibility as fostering justice overall, especially for individuals — even if that means working creatively around legal precedents. In contrast, many Obama appointees see a judge’s job as accurately applying established law as they understand it, even if doing so may lead to individual injustices.
