LA Times: Dodgers Need To Cut Accused Domestic Abuser Trevor Bauer

Thu Jul 15, 2021 4:06 pm

Stunning column today by the LA Times, taking a stand and insisting that the best thing for the Dodgers and city of LA is for Trevor Bauer to be cut in the wake of domestic violence allegations that are currently under investigation. Legally, it would be a very difficult maneuver, but a bold move indeed.

The shirt off Trevor Bauer’s back is gone, his jersey no longer available for purchase at the team store.

The clubhouse support for Trevor Bauer is gone, not one teammate agreeing to publicly offer even the mildest of affirmative testimonials, nobody even dare mentioning his name.

Every piece of evidence that Trevor Bauer ever pitched for the Dodgers is gone, save one.

What they are getting at is Bauer is on administrative leave, and despite the fact he probably won't pitch again this year, is still drawing salary of $1.5 million/week.

https://www.latimes.com/sports/dodgers/ ... ed-by-team

Former Oakland A's and Dodgers pitcher Dave Stewart voiced serious displeasure a few days ago with how the Dodgers have handed the Bauer situation, saying he will not attend 1981 World Series 40th anniversary celebrations this year:

“The organization isn’t what it was when we came through,’’ Stewart, a rookie relief pitcher on the 1981 World Series team, told USA TODAY Sports. “The Dodgers organization that I grew up in under the O’Malley family would never stand for that. The Dodgers should have stepped up in that situation, and they didn’t. You’ve got to have character standards.

“I told them, 'I can’t show up for that.’ "

When Stewart informed the Dodgers he won’t be attending the July 25 celebration, he said he received an e-mail that read: “The team and the Players Associations support the player until he’s guilty.’’

The MLBPA needs to allow more leeway for clubs to impose unpaid administrative leave for situations like these. Pro sports is a business, and if players invite major off-field distractions that can tarnish team reputation, then they should be prepared for whatever consequence that brings.

The "victim" was so traumatized, she went back a second time. Uh huh. She knew exactly what she was doing and was hoping to cash out on it:

Sadly those who are rich, celebrities or have political pull can far too often get away with predicate crimes that if they faced treatment like normal people for them wouldn't have got to the levels as with Bauer.
What I would like to see in all professional sport by negotiations is team owners and the player's unions agree to allow for suspensions for criminal charges if not at no pay but at least with a substantial reduction during a suspension like to league minimum for their years in the union. The team has lost a player's contribution from the suspension that could affect the chances of being in the playoffs, causes anger by fans and fellow players and possible losses of millions in revenues to team owners. There must be protections to recognize government rights of 'innocent until proven guilty' and of false charges but open criminal acts must be met with strong and immediate sanctions to discourage others from getting away with them.

My understanding is that he has not been charged, let alone convicted.

Seems to me that people are very quick to throw this guy under a bus.

The 2nd visit landed her in hospital. If there are no corroborating medical records obviously that would work in Bauer’s favor, but her attorneys did DD and obviously there are.

DV cases are delicate and charges are often not forthcoming overnight.

So it's the woman's fault? Should have known, but thanks for clarifying.

So under the laws of the nation where innocent until proven guilty, if innocent will the league and the team in addition to reinstating his salary, make up the lost earnings also pay compensation for reputational damage and future loss of income as other teams may not want to touch him, so his sports life is over.
Suspension with pay or reduced pay is the best option, anything else creates too much problems, at the end of the day, the law does not treat pro athletes any different, prosecutors maybe, but the law as written, no.

There is reputational damage for the club as well - precisely the reason players should not invite private situations that are liable to become public. It’s still a business - and a very public one at that.

It's a business, and the dollars are an issue. at this point the team is probably still playing the odds that he is somehow not guilty. I expect they have lawyers trying to figure a way out of this.

Difference is that the team can easily recover, unless as in the past high profile college coach scandals, the misdeeds were / was known by the organization and ignored.
Both parties are loosing money, the player if convicted will loose his freedom for a period of time and most likely will never play in the majors again. If no evidence is found that he is / was a serial offender and the team knew but ignored, the hit to the team will be minimal and they move on. Fans of pro sports are forgiving of the organizations and the wealthy owners who work for a living, athletes on the other hand are making millions to play sports.
The NFL just inked billions of dollars in TV contracts and promptly fired a bunch of staff, the same organization who a number of years ago locked out its players because their almost 50% share of billions of profit, profit not expenses, profit was too small. The Clippers survived their racist owner, other baseball teams survived serial cheaters from Pete Rose to Bonds and others, the teams survived, heck, even the cheating Astros did not loose their title and are merrily playing baseball, the teams will always survive, the players.....

I accept it is money to both sides, but the teams losses pales compared to what may potentially be a permanent loss of lively-hood to the player. Every effort will be made to preserve the team, after all, it is one of the greats in the sport, it is larger than any individual.

It's not all her fault but she did make the decision to go back.......

From the links:

Texts messages obtained by DailyMail.com appear to contradict some of the assault claims against Dodgers pitcher Trevor Bauer

But texts sent to Bauer on May 9 - after their first encounter - show Hill told him she enjoyed being 'choked out' during and asked him to do it again

'Never been more turned on in my life. Gimme all the pain. Rawr [sic],' she says during one sexual conversation

She described the encounter as the 'best sex of my LIFE' and admitted she had to quit the team's Pad Squad of 'brand ambassadors' because of their relationship

There's a huge difference between wanting choke play (operative word being PLAY) and ending up in hospital with facial injuries, bruises and scratches, and possible rape including battery of the genitals. We'll see what the medical records indicate beyond that as there was reportedly fracture somewhere as well - but that's substantial injury, not play. Last time I checked, when asking a partner what they want, it's proper to do what is requested, not openly wail and treat them as a punching bag. This dude is 186 cm and 90 kg...he has a responsibility to be careful regardless.

One big problem with this case was the team management delaying the suspension of Bauer. The story of his arrest got very quickly posted on the internet before the team had a chance to verify it and the circumstances for it. With such cases of violence against women as alleged with Bauer, there is a huge public demand to take immediate action, even before all the initial investigations are done. People don't want to wait for the judicial procedures to take place, to presume innocent until proven guilty, they have already been 'convicted by the court of public opinion' of their crimes and need to face immediate penalties.

Until no so long ago, sports teams would cover up or 'fix' the situation of criminal behaviors with police, prosecutors and the news media over assault, physical abuse, sexual harassment by players and team office staff, but that is no longer possible due to the internet and social media. Even with convictions, too many sports players can return to play due to being a 'first time offender' with no jail penalties or charges dropped due to a person's celebrity. Many got away with severe crimes and reinstated to teams although they never should have been allowed back (NFL's Ray Lewis and Michael Vick).

Again this sure looks like lack of due process. There has to be a procedure that anyone doesn't lose income or have their lives ruined until all the facts are in.

Due Process is for the law. Private companies can generally fire you for any reason. The only thing probably helping Bauer out right now is the MLB Players association.

He is getting his due process under the law. Employers don't have to care about what's going on in the legal proceeding, especially if it causes enough negative publicity. The only thing saving him at the moment is the fact his contract is still worth nine figures.

Didn't stop the MLB from suspending Bauer indefinitely. The MLB and also the NFL are notorious for suspending players before all the facts come out, ruining careers. Bauer's case is no different. Each respective league labels those players as guilty before anyone knows what really happened, in general. I honestly don't see Bauer ever returning to MLB.
