What IAG should learn from the Swiss

In short: national ownership and control are no longer required in order to execute international traffic rights. Instead, a local principal place of business will do. This is obviously accepted by any country where Swiss International and Edelweiss operate.

I am much too lazy to try an exact translation from the Swiss government site http://www.bazl.admin.ch. But I copied and pasted the document versions in French, German and Italian. All published back in 2012, by the way.

Depuis plusieurs années, les autorités suisses tentent, dans le cadre des négociations sur des accords bilatéraux, de remplacer la clause de «nationalité» («Ownership-and-Control») par le critère du siège principal («Principal Place of Business»), comme c'est de plus en plus souvent la cas au niveau international. Ce n'est plus la propriété de la compagnie mais uniquement le lieu où ladite compagnie a le siège de son activité commerciale principale qui doit prévaloir.

Die Schweizer Behörden streben seit mehreren Jahren bei Verhandlungen über bilaterale Luftverkehrsabkommen an, diese einschränkende «Nationalitäten»-Klausel («Ownership-and-Controll») durch das liberalere Kriterium des Hauptgeschäftssitzes («Principal Place of Business») zu ersetzen, so wie es international vermehrt praktiziert wird. Nicht mehr das Eigentum an einer Fluggesellschaft soll im Vordergrund stehen, sondern lediglich der Ort, an welchem die entsprechende Fluggesellschaft den Hauptsitz ihrer geschäftlichen Tätigkeiten hat.

Nel corso dei negoziati relativi agli accordi bilaterali, da anni le autorità svizzere mirano alla sostituzione di questa clausola limitativa di «Ownership-and-Controll» con il criterio più liberale, incentrato sulla sede principale della compagnia, del «Principal Place of Business». Questo principio è ormai sempre più diffuso a livello internazionale; pertanto non saranno più determinanti i rapporti di proprietà di una compagnia aerea ma unicamente il luogo dove essa ha la propria sede commerciale principale.

However, it should be noted that the implementation for Switzerland took a couple of years.
