Legal Use Of Logos!

Check out the logo for this spa maker!

isn't that the Airbus Industries logo turned 45 deg.?!! I have also seem another company (forgot the name) but they had the GF golden falcon as their logo. I am sure there are more out there. Are there any international rules and regulations about such uses?

No. Rotation is opposite direction as well as being multi-colored (just for starters).

Are there any international rules and regulations about such uses?

Yes, intellectual property law (patents & trademarks, etc.).

If my Law 101 serves me right, it depends on where the copyright/patent is registered. They need to be registered in multiple countries where the company wishes it be to a copyright/patent. If Airbus logo is an France/EU copyright, and also registered in US, Australia, Japan, India etc; then if it is not registered in Zimbabwe then I think there's no breach of rules if the logo is 'stolen' and used in Zimbabwe.

A French party, Chasse, Pêche, Nature et Tradition, has a logo which looks pretty similar to Garuda's one

Here in Canada there is a line of notebooks and stationary that I swear has the same logo as Airbus. I will try and check out the name tomorrow and see if it is the same.

The other day I noticed that Independence Air's color scheme and lower-case "i" logo in courrier-style font are exactly the same as the little "i" icon for more information in the newest versions of Microsoft Word--same blue and royal/purple lower case i in a circle.

similarity is not a legal claim.

if it aint identical, it aint a violation.

also see atlasjet of turkey (new colours) and easyjet similarities

I have got a very dubious one here  Wow!  Wow!  Wow!
Beside the logo, they have copied the name as well!!!



KLM in Iceland is some kind of a trophee maker, just take a look on their website: http://www.klm.is/

The owner of this company must have had some good experience flying KLM Royal Dutch Airlines, naming his own company after it.

But what I am asking myself is, how legal can this all be? Of course in this case it concerns a small company, but nevertheless they have used exact the same name and the same logo (with the exception of the little cross in the real KLM´s crown).

So what do you guys think of this one?  Nuts

This is not legal advice.

First: Logos fall under the ambit of Trademark Law, which falls under the umbrella term Intellectual Property.

Second: Trademarks serve as a "badge of origin" (European theory of the law) or as a "source indicator" (American theory of law) - both mean the same thing. Goods or services bearing the logo are associated with the manufacturer or provider.

Third: The Airbus Style Logo raises two issues.
Is there trademark infringement? Or, should the mark be cancelled (by way of opposition proceeding) because the mark is confusingly similar. In order for this to be outright infringement you would have to be affixing the mark on the same products or services.

In order to succeed in an opposition proceeding Airbus would have to show that consumers are likely to be confused - by seeing the Airbus logo used on or in connection with Spa Services consumers would think Airbus Industrie owns or operates the Spa/Hot Springs.

That's pretty much the law on the subject. . . in a nutshell.

It is a bit more subtle than that. The legal standard is more along the lines of "does it cause confusion in the minds of the public". Trademarks (brand names, logos, symbols) are all about creating a public identity. If someone else uses a variation of name, logo, symbol, etc that could readily be confused with an existing trademarked item, there could be grounds for a dispute, particularly if it is for a similar product or service or a broadly known brand.

And, yes it does depend on local laws, international treaties and the like.
