Again why fee the consumer when it is the airlines responsibility per the law.

Because they could evade it without consequence. And when it saves £, and you know you won't be punished, why not? Evidently a number of airlines do it – including legacy airlines like LH, as RJ100 testified – not just FR. And clearly extremely few people realise the law, so they wouldn't even think about pursuing it.

Quoting SandroZRH (Reply 48):
That's not what i said, read again.

You put:

Quoting SandroZRH (Reply 41):
we have a prosperous airline called LX now, which is way ahead of FR

To which I replied:

If you think LX is more financially or successfully "prosperous" than FR then clearly you live in a dream world.

Prosperous = main definition: financially successful.

Again you are charging a fee for a service that is already provided per the current law. Again a law that FR seems to take glee in circumventing when it is to there benefit.

No, they are not for weather etc.
Nevertheless, better get a good lawyer if you want compensation. It's also the legacy carriers strategy (usually) not to pay without lawsuit.
Asked LT for compensation - they declined, took them to court - I won 100%.

Good for you and RJ100.

In my mind unless they implement it properly - that is, highly effectively - it's pretty pointless: most European airlines evade it; most consumers aren't aware of it; and it seems like a time-consuming and expensive process to get what you are legally entitled to. Consumer-wise, it is, of course, a good thing - but only if it's properly implemented.

I still believe it's wrong for airlines to be held responsible if there's delays or cancellations actually due to the weather or other things that they can't control. If they're to blame, as I've said all along, then fair enough.

If it screws 'em, they're doughnuts: they keep coming back! And those who have never flown FR are equally doughnutesque: they have heard the "horror" stories, yet they still book! Either 47m FR consumers are jam-filled doughnuts or the overwhelming majority have fine experiences.

Just stumbled across this thread and had to say that you cracked me up... the above was a top-notch reply!  Big grin

Quoting [email protected] (Reply 10):
They could implement a mandatory, non-refundable We'll Protect You charge.

They could charge 50p/1 EUR per person per one-way.

If there's a cancellation it would then provide accommodation, transfers, and refreshments as appropriate to the cancellation (e.g. if there's another FR flight you can get on in 3 hours you'll receive less, e.g. just refreshments, than if it's the next day, when you'll receive accommodation, transfers, and refreshments).

50p for peace-of-mind and protection if things go wrong - it would only be for cancellations.

It'd probably generate £35m-50m (based on 50m pax), and I reckon only a small percentage of that fund would need to be used in one year for cancellations. The rest would be FR's. Mwahahahaha!

Only fair to make some money outta it for the added complexity and hassle.

Great idea - just another additional charge that most people wouldn't think twice about paying, even if they are entitled to compensation... you really should apply to FR when you get that degree!

Good question. Based on this evenings flights, not very often...

Good question. Based on this evenings flights, not very often...

I like the way that a large slice of that list isn't due to be airborne for some time yet.

Screwing pax over once is too many times. As a proportion, few flights run into serious problems - they still need to take proper care of people when the unfortunate does happen.

By the way, where is that info taken from?

That's why you purchase travel insurance before hand, but not with the airline. With travel insurance, you are protected anyway and you don't have to worry if the airline you flew on will take care of you or dump you or screw you over.

Even with travel insurance you must read the small print and check your policy. Some do not cover connecting flights and its amazing how many things come under their opt out ''Force Majoure'' section. Then there is the Excess on the policy which can be upto Euro 100 / $141 so you only get a small amount back.

I see SkyExpress (it’s a Russian discount airline) offers a “Flight Delay” option in the booking process. (Being a Russian carrier it obviously isn't covered by the EU's ineffective law that we have hitherto been discussing.) Its English site doesn't seem to be working properly my end, so I can't yet read the details. I'll try again soon.

In EC regulation 261/2004 it's also stated that the airlines have the duty to inform their passengers about their rights, in this case inform them about the compensation rules and the duty to care, etc etc. However since the airlines never took this law seriously (at least it seems they don't take it serious) there is room for a new business:

Delay services fee is 250 roubles. By paying this fee in case of flight delay a passenger gets the following services from Sky Express irrespective of the delay reason:

Hot food and drinks - when flight delayed for more than 3 hours, and further every six hours of delay.
Hotel accommodation and "airport-hotel-airport" transfer - when flight delayed for more than 6 hours during the night time, and for more than 8 hours during the daytime.

The Delay services fee is for one way flight only. In case of roundtrip flight the fee is doubled.

Sky Express obligations on Delay services provision arise only in case this fee is paid by passenger.

If a passenger has to change his/her plans because of delay non-scheduled flight and does not want to go on with the flight, the airline will rebook the ticket for the passenger for any other flight of the company without any additional fees.

Thanks OA.

250 RUB is £4.93/7.07EUR per one-way.

Finish here 2315 tonight and restart at 0700 tomorrow. Will have a think about making it optional, etc, in my sleep.

Quick thoughts:

I can’t say it immediately appeals – the idea of some getting help and others not isn’t appealing, and it could be a recipe for disaster – but it could generate considerable revenue: if FR charged £4.95 per one-way for cancellation/long delay protection and peace-of-mind and 10% of its customers paid it, I reckon it’d probably generate between £75m and £99m – far more than if it charged a small mandatory per person per one-way fee. It’d also go better with its increased personalisation stance, e.g. pay for what you want/need. And the actual costs of giving the protection would be less - you wouldn't have to pay often due to excellent punctuality and a low cancellation rate, and when you do there'd be fewer people - so more for FR to keep. Mwahahaha!   Of course, fully non-refundable. But hmm. I particularly dislike the idea of the extra complexity.

Time for my pre-departure snooze. Night!

This part is great:

We naturally pay for that??? Ha ha ha ha ha ha ha ha ha ha ha ha ha ha! Oh please, stop it!  rotfl  Sure, they pay up immediately like it's second nature to them. Yeah sure Do me a favour! After reading some FR horror stories; I wonder why people put up with it.
I realize that I speaking from the other side of the pond here, but there is a major difference in the quality of service you get from Ryan Air, Jet2, and Easyjet, as compared to the LCC carriers in the US (Jetblue, Virgin America, Southwest).
The fee structure in the USA is much less complicated (we pretty much are gauranteed to take 2 bags, a free non-alcholic drink, and a comfortable seat). There are no added fees for checking bags, paying for your ticket (that drove me nuts), so the fair that we are quoted is pretty close to what we pay. Once you actually pay for the flight, it is pretty similiar to flights with Euro LCC's.
That being said, there are certain things that people should expect, regardless of what they pay. Everybody deserves common courtesy (which I realize isn't that common), and to get to there destination. It seems FR feels that they are entitled to treat their customers as they please, because their fees are so low (I think some people writing responses on this site feel like wise). It seems Ryanair is more concerned about getting the last penny from the customer than actually serving them, and feels that the customer will always come back because they save a few quid. It is like the girl who keeps going back to the guy who cheats on her, WHY?
I'm quite if FR were to try that in America, they would end up giving all their profits to lawyers. While I think the American fascination with sueing is a bad thing, in FR's case that might not be bad thing.

From UK Airport News:

After 14 months of fighting, passenger wins compensation from easyJet over cancelled flight

16.10.07

Quote:
Budget airline easyJet has been forced to pay more than £1500 compensation to a London family after it cancelled a flight from Barcelona to Gatwick, refused to pay for accommodation and other expenses, and ignored EU rules on delays and cancellations, the Guardian newspaper reports.

But it took the passenger, Simon Langtree, 14 months to win his battle, with the airline even refusing to pay up after a court judgment. He finally obtained his compensation only after obtaining a court order allowing him to send in bailiffs to the budget airline.

It all began on August 10 last year. That was the day the transatlantic liquids terror plot was announced and passengers were banned from taking fluids on to flights, creating chaos in airports across the globe. Airlines struggled, with many flights delayed by hours.

Like many others, easyJet chose to cancel flights, including Mr. Langtree's 14:40 flight from Barcelona to Gatwick. After waiting for several hours in the terminal with his four children, he was told that the best easyJet could do was put him and his party on the 22:55pm flight the next night, arriving at Gatwick after midnight.

Mr Langtree asked about accommodation. easyJet staff flatly refused. Mr. Langtree quoted the EU Delayed Boarding Directive 261/2004, which gives easyJet has a duty of care to passengers. It must offer such items as accommodation, refreshment, transport to and from the airport and telephone calls when they cancel a flight.

easyJet airport staff denied all knowledge of the directive, offered no support and, like hundreds of other passengers, left the family to fend for themselves. The only support was to give passengers their premium-rate phone line in the UK to ring for information - which was constantly engaged or passengers were held in a long queue.

Fortunately, the apartment the family had stayed in during their holiday was still free and the family were able to re-occupy it for the night. But the cost was £288 for accommodation, food and transfers to and from the airport, plus another £59 for phone calls on his mobile from Spain to easyJet's 0871 number in UK to find out information.

When he got back to the UK, Mr. Langtree asked the airline for £346.90 in compensation. He sent an email and several letters, but received no response. After months of being stonewalled, he went online to moneyclaim.gov.uk and started a small claims court action.

easyJet filed a defence, which said that he had been informed in advance that the flight had been cancelled. Mr. Langtree says what the airline had sent was an email telling him in advance that there was a small change in the schedule, not a cancellation.

A hearing was set for June this year in Bow, London. But easyJet did not turn up. Mr. Langtree told the newspaper: 'I was only claiming £346.90 but the judge was very annoyed that easyJet had not bothered to turn up. He awarded me compensation and everybody else in my group, including a baby. In total it was £1,619.54.'

But it didn't end there. easyJet was given 14 days to pay, but they didn't do so, forcing Mr. Langtree to turn to bailiffs.

Asked if it was worth 14 months of battling, he told the newspaper: 'It is very, very stressful when a flight is cancelled and you are left with no assistance whatsoever. easyJet made no effort at all. I think they were relying on the fact that it takes so much hassle to get the money back and that even if you resort to legal action, you'll eventually drop out.'

'I am sure that of the hundreds of passengers affected, there were only a few of us who persisted in getting compensation. Although it takes time, the process is not hard and the courts are very helpful. It is only by more people taking airlines to court that they will start to carry out their legal responsibility in caring for passengers when they cancel or delay flights.'

When you choose to travel from PAR to MAD by bus (Ryanair) instead of an airplane (Air France, Iberia) you end travelling by BUS! Ryanair and all these "carriers" have nothing to do with the real air travel experience provided by a real carrier.

Thank God for that: air travel is for the most part merely another form of transportation. And that is what the overwhelming majority of people nowadays rightly view it as.
