former SWA/Boeing pilot and the 737 Max crashes

Wow! After the 737 MAX crashes, the Boeing 737 test pilot went to Southwest where he recently took a buy out. Now they are looking at federal charges against him.

A couple thoughts:

1) A good defense attorney should be able to sow tons of reasonable doubt that this guy *knowingly* misled the FAA when there is an entire web of engineers and data at play. It’s not like this man singlehandedly duped the FAA and a jury might react negatively to the perception that one person is being thrown under the bus, and…

2) Pursuant to (1) above, it’s sort of a travesty that one test pilot would be the only individual/entity charged when Boeing’s actions as a whole could be construed as criminal.

Fall guy. He was acting under the direction of Boeing leadership to minimize changes. Leadership was pressuring him to hide changes if he wanted to keep his job.

Prosecutors may pressure him to implicate higher ups in return for leniency. That’s a standard operating procedure for prosecutors.

I suspect they will but they might just ignore it for less publicity. This guy could be toxic for both Boeing and Southwest.

He wasn’t a “test pilot”. That’s commonly misstated in the media.

Boeing has several different pilot organizations. Engineering Pilots are the test pilots. Mark was a Technical Pilot, who are responsible for managing the procedures and training. At the time the Tech Pilots rarely actually flew Boeing airplanes.

Buy you stated that he is gone from SWA, so why would he be toxic?
