Photo Stolen By Syrian Air!

Hello,
I just noticed that SyrianAir has used one of my photos on their homepage without permission, they have just cropped the copyright bar.

Yes you can get a lot out of this if you want to!
Copyright is copyright, and it is your pic, so they have stolen it as you said.
And that's not legal!

First, before contacting them, make sure you'll save this website with your shot!!!

Print it, save it on your harddrive, make screenshots, no matter what!
Because if you contact them and they are deleting it, you'll have no prove!

So that's the hint i can give you.

I'm sure here are lots of spotters who know much about these things.!

Seems they have these ones too, but of course I don't know if permission was granted but I will contact photographers.

Most of the pics on their site are from this site. They seriously shouldn't have done that. It's not something you'd expect from a large airline like that.

Wake up...... Many LARGE corporations, airlines are not concerned with copyright violation especially when it come to photogs like you and I.

If they can get somthing for free they will.....the only thing we have working in our favor is 10000 other photogs who also surf the net and from time to time spot a THEFT.......

Best thing you can do is follow Spotterboys advice and negotiate perhaps just getting a photo credit.....remember their lawyers are on salary.

How many times have we seen this stealing of photos before?

Usually a non-Arab country (not that I would actually state the U.S. in particular!)

Get real, but I've a feeling our friends won't get too far with this one, but we've still gotta try.

I can't belive what I just read, the most ignorant comment I read in this forum for years. Maybe because I live some hundred kilometers from arab culture makes me suspicious of terrorism right? and by having said this, now I'm also part of the Devil forces in the World right?  Yeah sure

Daniel and I are twins, and as we've been using our dads, and most of the time goes spotting together, we've decided to upload our photos under the name "Daniel & Robert". Otherwise we'd probably have a lot of fights about who's turn it is to snap that rare bird on final  Big grin. And if we used separate names, there would be alot of photos looking almost exactly the same in the datebase.

I hope you understand.

Dear Moderators.

Could you do a better job at deleting posts that have nothing to do with the thread starter and allow discussion to tangent? This thread's going devolve into a piss-fest like so many threads here nowadays. For no good reason other than lax moderation.

We have a copyright violation whereby this airline used Airliners.net as a "Free Stock Image" site. Unfortunately, now it looks like it's going to turn into a thread about everything BUT the starter topic.

Keep the quality of the forums up by monitoring and deleting worthless posts.

Back on-topic:

Robert and others, pursue this to your fullest extent. Thieves need to understand that at the very least, their actions won't go without a response. If you don't hear back and they continue to use your images illegally, I would suggest asking A.net to pursue it as well, as the offenders have violated Airliners.net's Terms of Service listed under the "Use Photos" section where it states clearly:

You may not use these photos on any web page, commercial or non-commercial, for profit or non-profit, without written permission from the photographer.

They have violated TOS and are subject to legal action if A.net chooses to pursue. The question is—will they? Does A.net pursue individuals that break their terms of service? Can photographers count on A.net to help defend their intellectual property from undue theft?

I do not believe Airliners.net will persue this. They will leave it up to the photographer to battle it out.

I doubt you can get any compensation. You can ask them to remove the photos. I'd be interested in knowing if they comply.

I'm sure that officially they broke syrian law. But unfortunately the law is not very highly regarded in the Middle East. The truth of the matter is that the Syrian government controls the airline and the judicial system. I don't think they'll take a law suit seriously. The government's self-interest has a priority.

Ironically, at the bottom of their website you'll find: " © 2002-2003 Syrian Arab Airlines All Rights Reserved."

I doubt you could get anything, even if it occurred in the U.S., or similar countries.

Let's say it occurred in the U.S. To get any sort of measurable compensation, your photo needs to be registered with the U.S. copyright office, under "pre-publication" or something like that. Then, you "officially" own the copyright. Yes, I am fully aware that a copyright exists as soon as the image is in a tangible form of expression. If you do own the copyright, and the image is used in violation of the copyright, then you can really nail the person, and they're screwed, big time. Companies are aware of this, yet they are also aware that only ~15% of photogs register their images.

That being said, I have no earthly idea what the laws are in other countries, let alone Syria.

Even if this might be a surprise to many of the 'Western' Members here, even in Syria there are tight rules about Copyrightissues. But this is not the point. The point is that you need to register the photos exactly as Chrisair said.

ALL pictures on this site ARE copyrighted. What the hell are you talking about? I have to register my 15000 pictures one by one in order to put them on this website?????? I OWN copyright to all pictures that I TOOK. NO ONE can't change it unless I sell the image with copyrights. Think what you are saying before you post crap like this.

Just want to clarify...

Registration is not a requirement for copyright, it just gives you some advantages. Lack of registration does not equate to a surrender of copyright.

From the U.S. Copyright Office's "Copyright Basics":

COPYRIGHT REGISTRATION

In general, copyright registration is a legal formality intended to make a public record of the basic facts of a particular copyright. However, registration is not a condition of copyright protection. Even though registration is not a requirement for protection, the copyright law provides several inducements or advantages to encourage copyright owners to make registration.

Guys, don't just ask for removal or cease and desist:

Take a screen dump of the Syrian website with your photo and print it out
before they change it/remove it.
Also, get a similar print of your shot from airliners.net with the copyright banner.

Send it to them with a professional covering letter and invoice for 'commercial usage' with a demand for ???USD ...It's your call....
Make it a 'recorded' or 'signed for' delivery to ensure it has been accepted.

Sit back and wait for a response.
You are making a belated request for payment/usage.

I've done this a few times now and the results are worthwhile.
It doesn't matter if it's Syria. Same copyright rules apply.

I've received a mail about this matter from Ray, thank you very much, and I found one more of my shots on their website, of course with the copyright bar cut-off.

They've not asked for any permission to use any of my photos.
