BBC Copyright Infringement - A Head's Up

Thu Feb 12, 2009 3:01 am

A head's up if anyone receives an email from a Tom Geoghegan at the Beeb (email addy on request). He requested use of my image (https://www.airliners.net/photo/United-Airlines/Boeing-747-122/1380691/M/).

As usual, my response is to grant permission on receipt of their usual fee via my PayPal account. I get so many of these requests, my response, in short, is, "Show me the money!"

He nevertheless published the image, downloaded from Airliner.net, supplying a nonexistent entity for invoicing. The page: http://news.bbc.co.uk/2/hi/uk_news/magazine/7880808.stm

No, no, no. Wrong. You pay. THEN you publish. (He even got the caption wrong).

I've advised the Beeb and Airliners.net of the issue.

Quick followup note that, as suggested in similar discussions, I've invoiced the Beeb for rate + 50%.

I had an email from the same gentleman at BBC. He asked if he could use a cabin photo of my United 747-100... and after quoting him a price, he replied saying that he had found a more suitable photo for the story. Sorry to hear he 'did this to you'.

I have very rarely been paid before the use of an image, the important thing is the agreement rather than the money as accounts departments can move very slowly.
With unauthorised use I set the price and double it, telling them that I have done so for the breach of my copyright.
An organisation like the Beeb will pay and all sorts of other organisations have done so too.
I am willing to negotiate and a recent breach has earned me some work and flight in an R-44.
That came as a result of someone here spotting an unauthorised use and letting me know, something we could all try to do to help each other out when we see unattributed photos in or on the media ( the radio rarely uses them )

Of all the photo's I've sold and had published, I've always received payment after it has been published. That includes the BBC. We've discussed and agreed on a price, the photo has been sent (or downloaded from this site), I've submitted my invoice, the photo is used and 4-6 weeks later a cheque arrives through the post or by whatever method of payment that was agreed. I've yet to get any money up-front and certainly not from larger organisations such as the BBC where they have procurement procedures to follow that take time. If you've agreed terms, you'll get your money. The Beeb are about as reliable as they come, but it just takes a while.
